The damage from judgement could still miss back then, just not the debuff.
I don't think weather JoL or JoW has some down time would really affect PvE that much for ret paladins, its bad for prot paladins when your thunderclap falls off though.
I am only talking about making the debuff auto-hit again, not the damage which has always had a chance to miss.
